{"id":80051,"date":"2019-06-20T00:00:00","date_gmt":"2019-06-19T22:00:00","guid":{"rendered":"https:\/\/foraus.ch\/blog-post\/switzerlands-black-box-the-geneva-free-ports-and-the-global-art-trafficking\/"},"modified":"2026-05-27T11:21:35","modified_gmt":"2026-05-27T09:21:35","slug":"switzerlands-black-box-the-geneva-free-ports-and-the-global-art-trafficking","status":"publish","type":"blog-post","link":"https:\/\/foraus.ch\/fr\/blog-post\/switzerlands-black-box-the-geneva-free-ports-and-the-global-art-trafficking\/","title":{"rendered":"Switzerland\u2019s black box: the Geneva Free Ports and the global art trafficking"},"content":{"rendered":"\n<strong>After French President Macron announced his intention to help the repatriation of <a href=\"https:\/\/www.sciencesetavenir.fr\/archeo-paleo\/archeologie\/tresors-coloniaux-et-restitutions-du-patrimoine-africain-une-priorite-pour-le-president-francais_118768\" target=\"_blank\" rel=\"noopener nofollow\">African cultural heritage<\/a> looted during colonial times, several African states have <a href=\"http:\/\/www.rfi.fr\/afrique\/20190428-restitution-oeuvres-art-afrique-france\" target=\"_blank\" rel=\"noopener nofollow\">filed in their first requests<\/a>. While Switzerland does not share France\u2019s colonial past, it is still embroiled in the contemporary traffic of antiquities. This is due to legislative shortcomings and lax enforcement of regulations, especially in the Free Ports. Enforcing standards, higher accountability and cooperation with international bodies could improve this situation.<\/strong>\n\n<!--more-->\n<div class=\"fo-blog__detail__content__content\">\n<div class=\"fo-row\">\n<div class=\"fo-blog__content-html\">\n\n<b>Switzerland\u2019s art and antiquities market<\/b>\n\n<span style=\"font-weight: 400;\">The structure of the art and antiquities market is often described as \u2018grey\u2019, as licit and illicit activities often mix. This environment facilitates the laundering of stolen or trafficked items, a practice small antiquarians and <\/span><a href=\"https:\/\/www.thelocal.ch\/20180611\/answer-to-sothebys-and-greek-dispute-over-an-ancient-artifact-could-lie-in-basel\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">auction companies<\/span><\/a><span style=\"font-weight: 400;\"> alike have been involved in. Estimates of the illicit market volume range from <\/span><a href=\"http:\/\/www.unesco.org\/new\/fileadmin\/MULTIMEDIA\/HQ\/CLT\/images\/630X300\/Study_Prof_Renold_EN_02.pdf\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">6 to 8 billion<\/span><\/a><span style=\"font-weight: 400;\"> USD<\/span><span style=\"font-weight: 400;\">. <\/span><a href=\"https:\/\/edition.cnn.com\/style\/article\/europol-illegal-antiquities-organized-crime\/index.html\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">Human trafficking and illegal arms trade<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/foreignpolicy.com\/2018\/10\/10\/isiss-new-plans-to-get-rich-and-wreak-havoc\/\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">the funding of terrorist groups<\/span><\/a><span style=\"font-weight: 400;\"> such as Al-Qaeda or ISIS, have also been associated with it. Conflicts also increase looting and illegal excavations, as exemplified in Iraq and Syria. Switzerland, as <\/span><a href=\"https:\/\/unesdoc.unesco.org\/ark:\/48223\/pf0000226931_eng\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">\u00a0a large market country for art<\/span><\/a><span style=\"font-weight: 400;\">, has increased its regulations to prevent<\/span> <span style=\"font-weight: 400;\">art trafficking (see for instance the 2005 \u2018Loi pour le Transfer des Biens Culturels\u2019 and revision of customs laws in <\/span><a href=\"https:\/\/www.admin.ch\/opc\/fr\/official-compilation\/2007\/1411.pdf\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">2005<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.admin.ch\/opc\/fr\/official-compilation\/2015\/4917.pdf\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">2015<\/span><\/a><span style=\"font-weight: 400;\">). Yet, it remains an attractive transfer country to launder goods, due to its legislative framework and the presence of Free Ports.<\/span>\n\n<b>The Free Ports: Switzerland\u2019s weakest link<\/b>\n\n<span style=\"font-weight: 400;\">The Free Ports in Geneva are identified as weak points facilitating trafficking, a <\/span><a href=\"https:\/\/unesdoc.unesco.org\/ark:\/48223\/pf0000226931\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">UNESCO report indicates<\/span><\/a><span style=\"font-weight: 400;\">. They account for 48% of Swiss free ports in terms of storage capacity (around 56\u2019000 m<\/span><span style=\"font-weight: 400;\">2<\/span><span style=\"font-weight: 400;\"> out of 117\u2019000 m<\/span><span style=\"font-weight: 400;\">2<\/span><span style=\"font-weight: 400;\">) and specialise in art storage, <\/span><span style=\"font-weight: 400;\">possibly containing<\/span><a href=\"https:\/\/www.bilan.ch\/economie\/le_blanchiment_cette_epine_qui_agace_l_art\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\"> up to 1.2 million artworks<\/span><\/a><span style=\"font-weight: 400;\">. However, various shortcomings have been associated with Free Ports, and Geneva\u2019s in particular. A 2014 report by the Swiss Federal Audit Office highlighted various issues, including <\/span><a href=\"https:\/\/www.efk.admin.ch\/images\/stories\/efk_dokumente\/publikationen\/evaluationen\/Evaluationen%20(45)\/12490BE_Entrepots_douaniers_PUBLICATION_RAPPORT_FINAL.pdf#page=62\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">very few controls for its size (664 controls in Z\u00fcrich for 118 in Geneva) and a lack of standardised regulations and coordination<\/span><\/a><span style=\"font-weight: 400;\"> between customs office reports. Staff shortages also increase the risk of criminal activities: in 2015, <\/span><a href=\"https:\/\/www.tdg.ch\/geneve\/actu-genevoise\/Le-difficile-combat-contre-le-trafic-d-antiquites-en-Suisse\/story\/26887050\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">only four or five specialised staff<\/span><\/a><span style=\"font-weight: 400;\"> were assigned to check the 40 to 45 tons of transiting \u2018sensitive merchandise\u2019.<\/span>\n\n<span style=\"font-weight: 400;\">Inventories, key to ensure traceability and transparency, are often <\/span><a href=\"https:\/\/www.efk.admin.ch\/images\/stories\/efk_dokumente\/publikationen\/evaluationen\/Evaluationen%20(45)\/12490BE_Entrepots_douaniers_PUBLICATION_RAPPORT_FINAL.pdf#page=64\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">non-inexistent or outdated<\/span><\/a><span style=\"font-weight: 400;\">, despite the revised law introducing the obligation to hold inventories for \u2018sensitive merchandise\u2019 (this includes art and antiquities). Cultural goods have also been moved within the Free Ports before controls in some cases, with <\/span><a href=\"https:\/\/www.efk.admin.ch\/images\/stories\/efk_dokumente\/publikationen\/evaluationen\/Evaluationen%20(45)\/12490BE_Entrepots_douaniers_PUBLICATION_RAPPORT_FINAL.pdf#page=64\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">no sanction in case of non-compliance with inventory regulations<\/span><\/a><span style=\"font-weight: 400;\">. Such environment enables document falsification, e.g. modifying the origin of illegally acquired artefacts, and result in a situation in which the Free Ports are effectively facilitating art trafficking, by allowing stolen items to be stored during a \u2018cool down\u2019 period, before being sold years later. Despite the modified legislation of 2015 and tightened regulations, <\/span><a href=\"https:\/\/artlawfoundation.com\/site\/wp-content\/uploads\/2017\/11\/Hiler-David-pr%C3%A9sentation-22.11.2017.pdf#page=25\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">including systematically controlling incoming antiquities<\/span><\/a><span style=\"font-weight: 400;\">, (illegal) artefacts are still found. In 2016, <\/span><a href=\"https:\/\/www.independent.co.uk\/news\/world\/europe\/stolen-artifacts-palmyra-yemen-geneva-enesco-switzerland-a7454001.html\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">antiquities from Palmyra<\/span><\/a><span style=\"font-weight: 400;\"> were discovered, and experts estimate that <\/span><a href=\"https:\/\/parismatch.be\/actualites\/societe\/148295\/en-depit-de-la-chute-de-daech-le-trafic-dantiquites-pour-financer-le-terrorisme-va-sintensifier\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">trafficking of Syrian artefacts will intensify<\/span><\/a><span style=\"font-weight: 400;\">. It thus remains uncertain whether stolen art or illicitly excavated antiquities are not stored in Switzerland.<\/span>\n\n<b>Potential measures<\/b>\n\n<span style=\"font-weight: 400;\">Although the Free Ports are legally required to hold an inventory of \u2018sensitive merchandise\u2019, in practice, customs offices have not formulated any requirements. Upholding a higher standard of inventory quality would hinder frauds such as modifying the origin of goods. Extending the obligation of inventory to all \u2018sensitive merchandises\u2019 \u2013 including the objects already stored \u2013 would also help, while an administrative or penal sanction for outdated or missing inventories would encourage compliance. Reinforcing controls by customs offices, or allocating a higher budget and staff dedicated to controls could also prevent trafficking. Regarding legislation, the LTBC and the revision of borders laws were important steps to prevent trafficking, as mentioned above, but they do not cover all cases. Ratifying the UNIDROIT Convention of 1995 would therefore constitute a complement to these measures, while further bilateral treaties with source countries would aid repatriation. More generally, increased collaboration with stakeholders at a national and international level, including auction houses, customs offices, INTERPOL, antiquarians, legal advisors, as well as increased inter-cantonal collaboration, will be needed. This would allow to tackle newer issues in art trafficking, such as the rise of <\/span><a href=\"https:\/\/www.nytimes.com\/2019\/05\/09\/arts\/facebook-antiquities-syria-iraq.html\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">internet platforms selling trafficked artefacts<\/span><\/a><span style=\"font-weight: 400;\">, or the risks arising from an increasingly connected world. A UNODC report published in 2016 estimated that a <\/span><a href=\"http:\/\/www.unodc.org\/documents\/southeastasiaandpacific\/Publications\/2016\/Protecting_peace_and_prosperity_in_SEA.pdf\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">more interconnected Southeast Asia has increased trafficking<\/span><\/a><span style=\"font-weight: 400;\">;<\/span><span style=\"font-weight: 400;\"> as development in both Southeast and Central Asia improved, the trafficking of art from these regions, already a <\/span><a href=\"https:\/\/heritalert.wixsite.com\/alert-fr\/savickij\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">well-documented phenomenon<\/span><\/a><span style=\"font-weight: 400;\">, will undoubtedly intensify.
