The Russian invasion of Ukraine marks the return of the war of aggression \u2013 long believed to not only be outlawed but <a href=\"https:\/\/www.imf.org\/en\/Blogs\/Articles\/2022\/03\/15\/blog-how-war-in-ukraine-is-reverberating-across-worlds-regions-031522\" rel=\"nofollow noopener\">outdated in an interconnected, globalized world<\/a>. Furthermore, a <a href=\"https:\/\/www.hrw.org\/news\/2022\/03\/29\/ukraine-russia-uses-banned-antipersonnel-landmines\" rel=\"nofollow noopener\">plethora of alleged violations of international law<\/a> by <a href=\"https:\/\/www.bbc.com\/news\/world-europe-62073669\" rel=\"nofollow noopener\">Russian forces on Ukrainian soil is being investigated<\/a> by the ICC. And the world watches the new face of warfare unfold \u2013 with <a href=\"https:\/\/foreignpolicy.com\/2022\/05\/11\/killer-robots-lethal-autonomous-weapons-systems-ukraine-libya-regulation\/\" rel=\"nofollow noopener\">weapon systems more autonomous than ever<\/a> and the <a href=\"https:\/\/civiliansinconflict.org\/press-releases\/ukraine-russia-shift-in-warfare-tactics-is-resulting-in-mass-civilian-casualties\/\" rel=\"nofollow noopener\">shifting of battle activities to civilian spaces<\/a> such as urban centers. The signing of the <a href=\"https:\/\/reliefweb.int\/report\/world\/political-declaration-strengthening-protection-civilians-humanitarian-consequences-arising-use-explosive-weapons-populated-areas-final-rev\" rel=\"nofollow noopener\">Political Declaration on Strengthening the Protection of Civilians from the Humanitarian Consequences arising from the Use of Explosive Weapons in Populated Areas<\/a> on November 18 prompts the question of whether Ottawa\u2019s innovative idea can still serve as a template for <a href=\"https:\/\/www.hrw.org\/news\/2022\/10\/26\/safeguarding-civilians\" rel=\"nofollow noopener\">civilian protection today<\/a>. Or whether the treaty represents an anomaly \u2013 inept for the regulation of modern weapon systems and with a process no longer replicable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>A unique product of unique times?<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.apminebanconvention.org\/\" rel=\"nofollow noopener\">Ottawa Treaty<\/a> is historically significant in two different aspects. It was <a href=\"https:\/\/www.jstor.org\/stable\/27800234\" rel=\"nofollow noopener\">the first international treaty banning an entire<\/a> class of weapons used extensively by armed forces all over the globe. Unlike common arms control regimes, it is rooted in international humanitarian law. In a radically simple move, the treaty does not regulate but <a href=\"https:\/\/www.jstor.org\/stable\/27800234\" rel=\"nofollow noopener\">anathematize APL<\/a>. It relies on <a href=\"https:\/\/www.cambridge.org\/core\/journals\/international-organization\/article\/abs\/legitimacy-and-institutional-replacement-the-convention-on-certain-conventional-weapons-and-the-emergence-of-the-mine-ban-treaty\/B8250DE63673C1406BEF2EC10DA464B2\" rel=\"nofollow noopener\">stigmatization<\/a> and is therefore dependent on civil society to meet violators with necessary forms of dis-appropriation. The treaty also stands out for the speed at which the <a href=\"http:\/\/www.icbl.org\/en-gb\/home.aspx\" rel=\"nofollow noopener\">International Campaign to Ban Landmines<\/a> (ICBL) brought together states outside traditional forums like the <a href=\"https:\/\/www.un.org\/disarmament\/conference-on-disarmament\/\" rel=\"nofollow noopener\">UN Conference on Disarmament<\/a> that were blocked by <a href=\"https:\/\/www.cambridge.org\/core\/journals\/international-organization\/article\/abs\/legitimacy-and-institutional-replacement-the-convention-on-certain-conventional-weapons-and-the-emergence-of-the-mine-ban-treaty\/B8250DE63673C1406BEF2EC10DA464B2\" rel=\"nofollow noopener\">great powers\u2019 resistance<\/a>. But Ottawa\u2019s bold act of <a href=\"https:\/\/www.cambridge.org\/core\/journals\/international-organization\/article\/abs\/legitimacy-and-institutional-replacement-the-convention-on-certain-conventional-weapons-and-the-emergence-of-the-mine-ban-treaty\/B8250DE63673C1406BEF2EC10DA464B2\" rel=\"nofollow noopener\">norm entrepreneurship<\/a> was only possible on the shoulders of already established institutional frameworks like the <a href=\"https:\/\/www.icrc.org\/en\/war-and-law\/treaties-customary-law\/geneva-conventions\" rel=\"nofollow noopener\">Geneva Conventions<\/a> and the <a href=\"https:\/\/www.un.org\/disarmament\/the-convention-on-certain-conventional-weapons\/\" rel=\"nofollow noopener\">Convention on Certain Conventional Weapons<\/a> (CCW). The ICBL also managed to attract official and public interest for the idea of a total ban. And it mobilized a <a href=\"https:\/\/www.cambridge.org\/core\/journals\/international-organization\/article\/abs\/legitimacy-and-institutional-replacement-the-convention-on-certain-conventional-weapons-and-the-emergence-of-the-mine-ban-treaty\/B8250DE63673C1406BEF2EC10DA464B2\" rel=\"nofollow noopener\">critical mass<\/a> of supporting states with enough political cohesion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite drawing heavily on the same strategies, follow-up <a href=\"https:\/\/www.ohchr.org\/en\/instruments-mechanisms\/instruments\/optional-protocol-convention-rights-child-involvement-children\" rel=\"nofollow noopener\">campaigns<\/a> and <a href=\"https:\/\/www.clusterconvention.org\/convention-text\/\" rel=\"nofollow noopener\">treaties<\/a> were <a href=\"http:\/\/www.gencat.cat\/governacio\/pub\/sum\/dgrip\/MPDH_14_eng.pdf\" rel=\"nofollow noopener\">unable to deliver comparably rigorous results<\/a>. In addition, the liberal international order has not only come under fire by authoritarian states but can also no longer count on formerly reliable guardians. The <a href=\"https:\/\/www.state.gov\/briefing-on-the-united-states-updated-anti-personnel-landmine-policy\/\" rel=\"nofollow noopener\">United States\u2019 general alignment with Ottawa\u2019s provisions<\/a><u>,<\/u> for example, represents an important component of the ban\u2019s effectiveness.\u00a0 Its record of <a href=\"https:\/\/www.politico.com\/news\/2022\/06\/21\/biden-land-mines-trump-policy-00040925\" rel=\"nofollow noopener\">policy reviews or reversals<\/a> in recent years, however, potentially undermines collective dis-appropriation of violators. A general <a href=\"https:\/\/academic.oup.com\/icon\/article-abstract\/20\/1\/45\/6593266\" rel=\"nofollow noopener\">fatigue of multilateralism<\/a> and the current geopolitical fault lines make Ottawa an unlikely blueprint for future negotiations on civilian protection.\u00a0 All the while, technological dimensions of warfare have changed drastically. Civilians are increasingly at risk from <a href=\"https:\/\/autonomousweapons.org\/\" rel=\"nofollow noopener\">lethal autonomous weapon systems<\/a> (LAWS) which <a href=\"https:\/\/www.jstor.org\/stable\/27800234\" rel=\"nofollow noopener\">fundamentally disrupt the norms<\/a> underlying the regulation of warfare.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The absence of a revolution in the face of present urgencies<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Discussions by the <a href=\"https:\/\/blogs.icrc.org\/law-and-policy\/2021\/09\/29\/autonomous-weapons-systems-technology\/\" rel=\"nofollow noopener\">Group of Governmental Experts (GGE) in the context of the CCW<\/a> have yet to produce substantial results regarding the regulation of autonomous weapons. Unlike the ICBL, the <a href=\"https:\/\/www.stopkillerrobots.org\/\" rel=\"nofollow noopener\">Campaign to Stop Killer Robots<\/a> (CSKR) therefore has <a href=\"https:\/\/www.cambridge.org\/core\/journals\/international-organization\/article\/abs\/legitimacy-and-institutional-replacement-the-convention-on-certain-conventional-weapons-and-the-emergence-of-the-mine-ban-treaty\/B8250DE63673C1406BEF2EC10DA464B2\" rel=\"nofollow noopener\">no institutional setting against which to contrast a complete ban<\/a>. The mobilization of a critical mass for a ban of LAWS will also prove a much more uphill battle since the maximum reduction of risks <a href=\"about:blank\">has reached<\/a> <a href=\"https:\/\/academic.oup.com\/isq\/article\/62\/3\/548\/5098692?login=false\" rel=\"nofollow noopener\">broad public support<\/a>. In addition, proliferation issues are more complex, given that <a href=\"https:\/\/international-review.icrc.org\/articles\/stepping-back-from-brink-regulation-of-autonomous-weapons-systems-913\" rel=\"nofollow noopener\">autonomous technologies consist of more dual-use components<\/a> than APL. Convincing states to forego the opportunity to close gaps in technological capabilities will therefore be challenging. Despite the urgency, states are less willing to endorse a humanitarian approach to regulate LAWS. Anathematization and dis-appropriation <a href=\"https:\/\/www.jstor.org\/stable\/27800234\" rel=\"nofollow noopener\">seem to have failed to replace<\/a> traditional consequentialist instruments in the long run.
