{"id":80362,"date":"2024-07-23T05:00:15","date_gmt":"2024-07-23T03:00:15","guid":{"rendered":"https:\/\/foraus.ch\/blog-post\/reprisals-for-un-cooperation-the-plight-of-human-rights-defenders-in-repressive-states\/"},"modified":"2026-05-27T11:22:13","modified_gmt":"2026-05-27T09:22:13","slug":"reprisals-for-un-cooperation-the-plight-of-human-rights-defenders-in-repressive-states","status":"publish","type":"blog-post","link":"https:\/\/foraus.ch\/fr\/blog-post\/reprisals-for-un-cooperation-the-plight-of-human-rights-defenders-in-repressive-states\/","title":{"rendered":"Reprisals for UN Cooperation: The Plight of Human Rights Defenders in Repressive States"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Civil society activists from the NGO Human Rights Center Viasna were subject to <\/span><a href=\"https:\/\/www.ohchr.org\/en\/documents\/reports\/ahrc5461-cooperation-united-nations-its-representatives-and-mechanisms-field\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">raids, arbitrary arrests, and criminal charges<\/span><\/a><span style=\"font-weight: 400;\"> following their intensified cooperation with the UN human rights section. Similarly, human rights defenders from the Saudi Association of Civil and Political Rights faced <\/span><a href=\"https:\/\/documents.un.org\/doc\/undoc\/gen\/g23\/161\/72\/pdf\/g2316172.pdf?token=g9MFgpJrjJMaYQo1KR&amp;fe=true\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">imprisonments and travel bans<\/span><\/a><span style=\"font-weight: 400;\"> for allegedly providing \u00ab\u00a0false information\u00a0\u00bb to the UN Special Procedures. In another case, human rights lawyers in Yemen were <\/span><a href=\"https:\/\/documents.un.org\/doc\/undoc\/gen\/g23\/161\/72\/pdf\/g2316172.pdf?token=g9MFgpJrjJMaYQo1KR&amp;fe=true\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">intimidated and harassed<\/span><\/a><span style=\"font-weight: 400;\"> for sharing information with the UN and other international organizations.\u00a0<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Unfortunately, these cases of state violence in response to acts of cooperation with the UN are not isolated examples, but rather illustrate of a profound global problem. The UN Secretary-General publishes an <\/span><a href=\"https:\/\/www.ohchr.org\/en\/reprisals\/annual-reports-reprisals-cooperation-un\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">annual report on cases of state reprisal<\/span><\/a><span style=\"font-weight: 400;\">s<\/span><span style=\"font-weight: 400;\"> for cooperation with the UN. This report lists all states where there is evidence that human rights defenders have faced retaliation in response to their involvement with the UN. Figure 1 shows how often each state was mentioned in these UN reprisal reports over the period from 2010 to 2023. The world map illustrates that state reprisals in response to cooperation with the UN have occurred in various countries, and that the issue is especially profound in China and Saudi Arabia.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Figure 1: Global distribution of reprisals for cooperation with the UN (2010-2023)<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/foraus.ch\/wp-content\/uploads\/2024\/07\/Mapforaus-scaled.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\" wp-image-56404 aligncenter\" src=\"https:\/\/foraus.ch\/wp-content\/uploads\/2024\/07\/Mapforaus-300x105.jpg\" alt=\"\" width=\"686\" height=\"240\" \/><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Source:<\/span><span style=\"font-weight: 400;\"> Original data analysis based on data provided by the <\/span><a href=\"https:\/\/www.ohchr.org\/en\/reprisals\/annual-reports-reprisals-cooperation-un\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">UN Secretary-General<\/span><\/a><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">While this evidence already suggests that state reprisals are a major global concern, it is important to emphasize that the reprisal cases <\/span><i><span style=\"font-weight: 400;\">reported<\/span><\/i><span style=\"font-weight: 400;\"> by the UN Secretary-General represent only a subset of the <\/span><i><span style=\"font-weight: 400;\">actual<\/span><\/i><span style=\"font-weight: 400;\"> number of reprisal cases. First, there is likely to be a huge <\/span><a href=\"https:\/\/heinonline.org\/HOL\/Page?handle=hein.journals\/surij17&amp;div=14&amp;g_sent=1&amp;casa_token=8hW9XhpMkmUAAAAA:F53_1kX2uJ5sk1jCxpOdKXGk8m4Ke7UESAfN7VdkisfBgp6h9nkEfAgBk-zthN6eBLUGxA\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">dark figure<\/span><\/a><span style=\"font-weight: 400;\"> of state reprisals that occur outside the international spotlight, which do not appear in the reprisal report. Second, the UN Secretary-General is committed to \u00ab\u00a0<\/span><a href=\"https:\/\/www.ohchr.org\/sites\/default\/files\/Documents\/Publications\/Chapter02-MHRM.pdf\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">do no harm<\/span><\/a><span style=\"font-weight: 400;\">\u00a0\u00bb principles and therefore only reports on cases of reprisals when the risk of further reprisals in response to inclusion in the report is limited. Thus, the UN reprisal reports reveal only the <\/span><a href=\"https:\/\/reliefweb.int\/report\/world\/un-action-reprisals-towards-greater-impact-quantitative-analysis-scope-and-impact-un\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">tip of the iceberg<\/span><\/a><span style=\"font-weight: 400;\"> of the actual number of cases of state reprisals for cooperation with the UN.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">As a result of such reprisals, human rights defenders may be increasingly intimidated from cooperating with the UN. To the extent that human rights defenders are deterred from providing information to the UN, repressive states may be able to commit human rights violations in secret without facing international accountability. Hence, state reprisals threaten the core mission of the UN human rights section, and it is of the utmost importance to address this issue and develop effective safeguards.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">In light of the complexity of the problem, this article can only make a few suggestions, but hopes to stimulate a broader debate. First, the UN should strengthen access points for filing anonymous complaints about human rights violations. Given the pervasive risk of state reprisals, it is of great concern that public UN <\/span><a href=\"https:\/\/www.ohchr.org\/en\/special-procedures-human-rights-council\/what-are-communications\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">communications<\/span><\/a><span style=\"font-weight: 400;\"> that follow up on individual complaints contain personal information about victims of human rights violations including their names. To protect the anonymity of human rights defenders, the UN should not only anonymize these documents but also <\/span><a href=\"https:\/\/www.cao-ombudsman.org\/sites\/default\/files\/2021-04\/APPROACH%20GUIDE%20FOR%20INDEPENDENT%20MECHANISIMS.pdf\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">encrypt<\/span><\/a><span style=\"font-weight: 400;\"> all online contact forms to prevent repressive states from intercepting sensitive information.\u00a0<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Second, the UN should strengthen its follow-up mechanisms to monitor the situation of human rights defenders after their cooperation with the UN. Ideally, the UN would establish follow-up mechanisms along the lines of <\/span><a href=\"about:blank\"><span style=\"font-weight: 400;\">national witness programs<\/span><\/a><span style=\"font-weight: 400;\"> for human rights defenders who have provided information to the UN. Third, the UN must strengthen its <\/span><a href=\"https:\/\/www.ohchr.org\/en\/special-procedures-human-rights-council\/acts-intimidation-and-reprisal-cooperation-special-procedures\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">focal points on reprisals<\/span><\/a><span style=\"font-weight: 400;\"> and improve cooperation with civil society actors and national governments to ensure a coordinated, effective, and timely response to state reprisals<\/span><span style=\"font-weight: 400;\">. <\/span><span style=\"font-weight: 400;\">The UN should also advance policy instruments such as the <\/span><a href=\"https:\/\/docstore.ohchr.org\/SelfServices\/FilesHandler.ashx?enc=FhOD6sgqgzAhFXD9F%2FeKaHS27qvpChe6dsIpF%2FUJwxlT1COp6pApv%2FKS4sCgBIC1dCOEV43rwH1wkdiQZvdiUPFKSS4A2LtO7g1gkxlLOHgXBOKsf5U0G2pTrt8AZnlZ\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">San Jos\u00e9 Guidelines against Intimidation and Reprisals<\/span><\/a><span style=\"font-weight: 400;\">, whose scope is currently limited to states that have ratified international human rights treaties. Overall, the UN member states need to invest greater resources to address the issue of state reprisals.
